Appeal Court sacks APC’s Senator elect, Orders INEC to issue certificate of return to his opponent
According to the judgment read by Justice Stephen Adah, the Court of Appeal set aside the judgment of the Federal High court who hitherto dismissed the preliminary objection by Senator David Umaru’s counsel, Chris Osuagwu on the ground that the suit was filed outside 14 days stipulated by the law on pre-election matters.
The Judge noted that the court lacked the jurisdiction to entertain the matter having become statute barred by law.
He directed the Independent National Electoral Commission (INEC) to issue a certificate of return to Senator David Umaru.
In a chat with newsmen, counsel to Sani Musa, Wole Olanipeku expressed the intention of his client to appeal the ruling of the Court of Appeal at the Supreme Court.
